Mosher & Skorina, P.C. turns $6,300 offer into $165,000 settlement in car crash case
Mission Viejo, CA – 3/24/10 – Mosher & Skorina, P.C. successfully turned an offer of $6,300 into a $165,000 settlement on behalf of a client injured in a car wreck on the I-5 freeway in Orange County.
For 15 months the insurance company refused to offer anything more than $6,300 and hired several defense doctors who claimed the client's injuries either pre-existed the collision or were unrelated to it. The client, a 62 year old retiree, was rear-ended after bringing his vehicle to a sudden stop when traffic stopped in front of him. The other driver and his insurance company contended that Mosher & Skorina's client caused the collision by cutting in front of the defendant and coming to an abrupt stop. The defendant also contended that an unidentified party left an obstacle on the roadway and bore responsibility for the collision.
The parties went to mediation but the insurance carrier refused to budge from its $6,300 offer. The settlement was not achieved until the parties were about to start trial. "I believe we demonstrated the lack of credible evidence supporting the defense theories and that we were prepared to try the case," said attorney Christopher Skorina.
Dealing with low-ball offers from insurance companies is nothing new in personal injury litigation. The public often fails to realize that when they represent themselves in pursuing insurance claims they have professional claims negotiators as adversaries. "Claims adjusters are smart and experienced, and their job is to resolve claims for as little as possible. They are not paid a bigger bonus because they approved a higher payment to an injured party." says Skorina. "In this case, for example, the client contacted me only after attempting to resolve the case on his own and becoming exasperated by insurance company's failure to offer him anything more than $6,300. The client knew he was hurt, knew his vehicle was totaled, but the carrier just would not budge."
What is the secret to obtaining fair compensation? "It is not a secret, but rather hard work and money. Your attorney has to invest the time, hire experts if necessary, and diligently prepare the case. You have to educate the insurance company on two levels: first, you have prove their insured caused harm to your client; second, you have to demonstrate you are prepared to try the case if a reasonable offer is not made."
